MINUTE entry before the Honorable Franklin U. Valderrama: Per the Notice of Dismissal of John Does 1-10 11 , all claims against John Does 1-10 are dismissed without prejudice. The Court has reviewed the Agreed Motion for Entry of Stipulated Final Judgment and Permanent Injunction (Motion) 12 . Pursuant to Federal Rule of Civil Procedure 41(a) and the Motion, Plaintiff's claims against Defendant JJS Corporation are dismissed with each party to bear its own costs, expenses, and attorneys' fees. Enter Stipulated Final Judgment Order. The parties request that the Court dismiss the case with prejudice but retain "jurisdiction of this matter in law and in equity for the purpose of enforcing and/or adjudicating claims in violation of this Stipulated Final Judgment and Permanent Injunction." R. 12 3. The Court advises the parties that, generally speaking, Seventh Circuit decisions hold that dismissals "with prejudice" leave the Court without jurisdiction to enforce a settlement agreement or resolve liens. See Shapo v. Engle, 463 F.3d 641, 646 (7th Cir. 2006); Hill v. Baxter Healthcare Corp., 405 F.3d 572 (7th Cir. 2005). Therefore, the case is dismissed without prejudice and with full leave to reinstate via motion filed by 06/16/2024. If no motion to reinstate is filed by that date, then the dismissal will automatically convert to a dismissal with prejudice, without further action by the Court. Civil case terminated.
