ORDER. On 9/29/2026, the Court conducted a hearing on Plaintiff's Motion for Leave to File Third Amended Complaint. Plaintiff appeared through counsel, Scott Mann. Defendant RoadSafe Traffic Systems, Inc., appeared through counsel, Richard Wassall. Defendant Koss Construction, Inc., appeared through counsel, Peter Collins. For the reasons stated during the hearing, the Court denies Plaintiff's 49 Motion for Leave to File Third Amended Complaint. A written order will follow. After discussion during the hearing, the Court found good cause to grant the parties' 74 request to extend deadlines to take certain depositions. Accordingly, the Court sets the following deadlines: 1) By no later than 10/6/26, Plaintiff should file Notices regarding taking the Rule 30(b)(6) depositions discussed at the hearing; 2) The parties should complete the 30(b)(6) depositions and depositions of the KDOT employee(s) and Steven Cannella, MD, by no later than 11/6/26; 3) Discovery, for the sole purpose of taking these depositions and any written discovery requests resulting therefrom is extended to 11/17/26. Any written discovery request issued before 11/17/26 must be served in time for a response due date no later than the close of discovery; 4) Proposed pretrial order due 11/12/26; 5) Final Pretrial Conference set for 11/17/2026 at 11:00 AM in Video Conference - Zoom before Magistrate Judge Gwynne E.
