The Court denies the motion to remand and grants the motion to compel arbitration in substantial part. The Court maintains its order requiring the parties to submit this action to arbitration pursuant to the terms of the arbitration agreement. See 9 U.S.C. § 5. The case remains stayed and administratively closed pending resolution of the arbitration. See id. § 3. The periodic status report requirements of the original order remain in effect. (SEE DOCUMENT FOR ALL SPECIFICS AS DISCUSSED HEREIN AND SEE FOOTNOTE 1: Since the filing of the original order compelling arbitration, Plaintiff Anthony Pineda petitioned the Ninth Circuit Court of Appeals for a writ of mandamus.
