MINUTES (In Chambers) Order GRANTING Defendants' Motions for Summary Judgment [Dkts. 90, 94, 95, 96, 97, 99] by Judge Kenly Kiya Kato. For the reasons set forth above, Defendants' Motions for Summary Judgment are GRANTED, and the Court declines to exercise supplemental jurisdiction over Plaintiff's remaining state-law claims. Accordingly, the Court ORDERS as follows: 1. With respect to defendant Pacific Maritime Association, all claims are DISMISSED with prejudice; 2. With respect to defendants APM Terminals Pacific LLC, Total Terminals International LLC, SSA Terminals LLC, LBCT LLC, and ILWU Local 26: a. Causes of Action One, Three, and Four are DISMISSED with prejudice; b. Plaintiff's ADA claims under Causes of Action Two and Five are DISMISSED with prejudice; and c. Cause of Action Six, Plaintiffs FEHA claim under Cause of Action Two, and Plaintiff's Section 1102.5 claim under Cause of Action Five are DISMISSED without prejudice to refiling in state court.
