The Court conducted a status conference regarding the pending motions, including Plaintiff's motion for leave to file a third amended complaint, Defendants' motions to dismiss, the Louisiana Department of Health's motion to set aside the clerks entry of default, and Plaintiff's requests for discovery. Defendants indicated a willingness to withdraw opposition to the third amended complaint, subject to their reservation of all substantive defenses and to the settling of a governing pleading and the status of all current or prospective parties. All parties requested/consented to disposition of the motion to set aside and the motion to amend, to be followed by a responsive period with discovery stayed to amend or re-file motions to dismiss. The parties also requested/consented to entry of a scheduling order governing any responsive pleadings and related motion practice.The Court took the pending matters under advisement and will issue a written ruling.
