   TEXT ORDER entered by Magistrate Judge Ronald L. Hanna on August 19, 2026.: In response to Plaintiff's 2 Motion to Appoint Special Representative for Deceased Defendant, the Court 4 ordered Plaintiff to file a supplemental brief explaining why the Court has authority to apply 735 ILCS 5/13-209(b) outside the civil-rights context and the applicability of Section 209(b) to the facts here. Plaintiff timely filed a 9 brief in support of her motion. Plaintiff states that Defendant Laura M. Pietkiewicz, who Plaintiff proposes to appoint as the special representative, has consented to the requested appointment. Upon review of Plaintiff's brief and without opposition from Defendants, the Court is persuaded that it has authority to appoint a special representative in this case. Accordingly, Plaintiff's 2 motion is GRANTED. Laura M. Pietkiewicz is appointed as special representative for Jakub Pietkiewicz, deceased, for the limited purpose of defending this action. As Plaintiff correctly notes, any recovery on the claim against Jakub Pietkiewicz will be limited to the proceeds of applicable liability insurance in accordance with Section 209(b)(2). (BMG)
