Status Conference
Minute Entry and Order: A telephonic Pre-Settlement Status Conference was held on 8/11/2026 before Magistrate Judge Taryn A. Merkl. Appearances by Plaintiff pro se Yitzchok Zylberberg and Mallory Campbell and Mary Ellen Donnelly for Defendant. A representative of Defendant, Scott Goodman, was also present. Discussion held regarding the status of the non-monetary terms of the settlement agreement, as raised in the parties' letters, filed at ECF 72 , ECF 75 , and ex parte, including discussion held under seal starting at 3:48 p.m. Defense counsel represented that she would confirm her client's position as to the three (3) open issues discussed in the conference. The parties confirmed their intent to meet and confer on the remaining terms of the settlement, in accordance with the discussion held in the conference, on 8/14/2026. By 8/24/2026, the parties are directed to meet and confer and to file a joint letter, apprising the Court of their progress in finalizing the three (3) open issues. In the event that the parties achieve a final agreement, they are respectfully directed to propose a date by which they will file a stipulation of dismissal.
As discussed on the record, the parties are encouraged in the strongest possible terms to finalize this settlement, which would consummate a settlement reached in principle at mediation in December 2025; failure to finalize the settlement as soon as practicable will leave the Court no choice but to return the case to active litigation.
