Order on Motion for Extension of Time to Amend Order on Motion for Extension of Time to Complete Discovery
ORDER denying without prejudice and with leave to re-file 39 Motion for Extension to Extend Case Management Deadlines. Given the age of this case and number of prior extensions, the Court will not grant such a large extension for an unknown number of depositions, but it will entertain a limited extension for particular purposes. As such, the Court ORDERS the parties to meet and confer regarding any remaining fact witness depositions the parties wish to take and to begin scheduling those depositions immediately through December 2026, if necessary. The parties may then file a new motion to extend the fact discovery deadline which should indicate the individuals to be deposed and any agreed to dates. Any such motion must be filed by 9/30/2026. To the extent the parties are unable to agree on the length of an extension, the number of depositions, or deposition dates, they may indicate as much in either a joint or separate filings by 9/30/2026.
