Order on Motion for Pre Motion Conference
ORDER. The Court has received the proposed schedule by MERS and MERSCORP (the "MERS Defendants") regarding their anticipated motion to dismiss and the letter request by CitiMortgage, Inc., Citigroup, and Citibank (the "Citi Defendants") for a pre-motion conference regarding an anticipated motion to dismiss. (ECF Nos. 26 , 27 .) The Court finds that a pre-motion conference is not necessary at this time and waives the pre-motion conference requirement. The parties shall comply with the following briefing schedule: The MERS Defendants and the Citi Defendants shall file their respective motions to dismiss by August 7, 2026. Plaintiffs shall file a combined opposition to the motions to dismiss by September 7, 2026. Defendants shall file any replies to the motions to dismiss by September 21, 2026. The briefing schedule set forth in the Court's May 20, 2026 Order regarding Cenlar and Fannie Mae's motion to dismiss remains unchanged. (Elec. Order, May 20, 2026.) Within one week of the completion of briefing, Defendants must deliver to Chambers two courtesy copies of Defendants' fully-briefed motions to dismiss, including all parties' briefing and exhibits. Defendants must comply with the Court's Individual Rules regarding for the provision of courtesy copies, Individual Rule 1.3, as well as the following formatting requirements:(1) All binder spines must identify the case name, docket number, and binder's contents.
