Text Order ~Util - Terminate Motions
TEXT ORDER - The Court is in receipt of Plaintiff's letters and filings (ECF Nos. 57, 65, 81-82, 84) indicating that his former attorney submitted the Second Amended Complaint ("SAC") (ECF No. 54) without Plaintiff's permission. See, e.g., ECF No. 82 (Stating that Plaintiff's counsel "improperly, filed his unilateral, 9-10-25 SAC to the Court without my input or approval of its content"). Accordingly, in the interest of justice, Plaintiff is granted leave to file a third amended complaint. Plaintiff shall do so by indicating the factual and legal allegations that Plaintiff believes his attorney omitted or incorrectly included in the SAC. He shall indicate such omissions or additions "by bracketing or striking through the materials to be deleted and underlining materials" that he adds into his third amended complaint. See Local Civil Rule 15.1. For the sake of clarity, Plaintiff is instructed to maintain the numbered paragraph format as well as the listing of individual Counts as used in the SAC. Given that Plaintiff is granted leave to amend his complaint, Defendants' motions (ECF Nos. 61, 62, 71, 75) are administratively terminated. So Ordered by Judge Claire C. Cecchi on 5/20/2026. (jl, )
