Scheduling Order
ORDER: The Court grants the parties' request for an extension of time. See ECF No. 10 . The parties shall file the joint letter and proposed case management plan required by the Court's prior scheduling order, see ECF No. 9 , on or before September 23, 2026.However, on that same date, the parties shall serve on each other, but shall not file with the Court, their initial disclosures required by Rule 26(a)(1). In light of the additional time afforded by this extension, the parties' proposed case management plan must provide for the service of their initial interrogatories and requests for production of documents within two weeks of the filing of the case management plan, or else the parties' joint letter shall explain with specificity why they need additional time.If the parties do not submit a proposed case management plan by September 23, 2026, then the Court will promptly enter a discovery schedule allowing no more than 90 days for fact discovery without seeking further input from the parties. The Court reminds the parties that they must diligently pursue their discovery obligations concurrently with their settlement efforts, in accordance with the deadlines in the Court's scheduling order. See ECF No. 9 . The Court will not extend the current deadlines for fact or expert discovery unless the parties demonstrate good cause, and the fact that the parties have been pursuing settlement negotiations will not by itself constitute good cause. Ordered by Judge Hector Gonzalez on 9/9/2026. (CBF)
