PAPERLESS ORDER: The Court is in receipt of Defendant Momentum Solar, LLC's Notice, in which it states obliquely that it "cannot maintain that there is complete diversity in this case as a result of its own internal corporate examination and therefore waives any claim to diversity jurisdiction" 29 . The Notice does not provide any supporting information, attachment, or affidavit, and Defendant Momentum still has not filed a certificate of corporate disclosures as required by Fed. R. Civ. P. 7.1 23 . Meanwhile, Defendant Dividend Finance Inc. has stated previously that it attempted diligently to obtain information about the citizenship of Defendant Momentum's members but has been unable to provide any additional information because such information is in Defendant Momentum's possession 25 13 . All the while, on May 22, 2023, Defendant Momentum moved to compel arbitration and/or to dismiss Plaintiff's Complaint 28 . Under these circumstances, Defendant Momentum is directed as follows. On or before June 4, 2024, Momentum Solar, LLC shall (1) file with the Court specific and supporting documentation reflecting a lack of complete diversity; and (2) a complete and accurate certificate of corporate disclosures.
