MINUTE ORDER: The Court has reviewed the 200 Joint Status Report and the parties' request for a settlement conference. The parties seek to complete mediation before October 15th. The Court agrees that mediating sooner rather than later would be beneficial given the state of discovery and the particular circumstances of this case. However, the Court cannot accommodate the parties' schedule and moreover, is concerned that its adjudication of recent disputes and likely adjudication of future disputes (as forecasted in the 200 Joint Status Report), might make the Court less effective in mediation than a third-party mediator. Thus, the Court refers the parties to Hon. Michael E. Hegarty (Ret.), JAMS Mediator and Arbitrator (www.jamsadr.com/neutrals/hegarty). The Court has confirmed his availability for September 21 and 25 as well as October 1 and 4. The parties shall jointly contact him, or another mutually agreeable third-party mediator, no later than September 1, 2026, to secure a date and time for mediation. The parties shall file a Joint Status Report on or before September 4, 2026, confirming they have secured a mediation date, and indicating whether they believe a temporary stay of discovery would be an effective way to conserve resources and increase the likelihood of resolution.
