Minutes of proceedings [non-document] before Judge Charles Esque Fleming. The Court held a telephone status conference on August 27, 2026, at 12:00 PM. Attorneys Stephen Zashin and Ami Patel presented for Plaintiff. Attorney Henry Grendell presented for Defendant Michael Tousey. Attorneys Lynn Larsen and Griff Towle presented for Corporate Defendants. The parties are in the process of scheduling a mediation date with a private mediator. The parties are ORDERED to file a joint status report notifying the Court of their mediation date. Plaintiff's motion to strike is DENIED. The parties are instead ordered to brief the pending motion to clarify (ECF No. 338 ) and motion to modify (ECF No. 339 ) as follows: Plaintiff has until September 14, 2026, to respond to the pending motions and file its own motion for clarification, limited to matters Plaintiff believes the Court did not address in its Memorandum Opinion and Order (ECF No. 335 ). Defendants have until September 21, 2026, to file reply briefs regarding their respective motions. Defendants shall respond to Plaintiff's motion to clarify by September 28, 2026. Plaintiff may file a reply brief by October 5, 2026. All documents SHALL be filed by close of business on their respective due dates. Page limits are governed by L.R. 7.1(f) and WILL BE ENFORCED. The Court discussed a final pretrial date of April 12, 2027, and a trial date of May 17, 2027; all parties indicated they are available on those dates.
