Order to Show Cause
ORDER TO SHOW CAUSE: Plaintiff has requested certificates of default against Defendants Mehreen Shah & Mona Shah & Associates PLLC 143 - 146 . These Defendants were added to this case on 5/19/2026 when the Court granted Plaintiff leave to file a Fourth Amended Complaint 118 .
A party may respond to a complaint by filing a motion pursuant to Federal Rule of Civil Procedure 12. Judge Block's rules state "[s]ervice of the [pre-motion conference] letter by the moving party within the time requirements of Rule 12 of the Fed. R. Civ. P. shall constitute timely service of a motion made pursuant to Fed. R. Civ. P. 12(b)." Individual Rules of Judge Frederic Block § 2.A. Defendants Mehreen Shah and Mona Shah & Associates were served with the Fourth Amended Complaint on 5/29/2026, and their answer was due 6/19/2026 132 - 133 . These Defendants filed on 6/18/2026 a motion 134 requesting a pre-motion conference in anticipation of a motion to dismiss. That letter was served on Plaintiff when it was filed on ECF. Accordingly, Defendants Mehreen Shah and Mona Shah & Associates have responded to the Fourth Amended Complaint, and default against them is not appropriate. Plaintiff's requests for certificate of default are therefore DENIED.
Given the above, and in light of the history of Plaintiff's filings in this case that do not comply with the Court's rules, Plaintiff's counsel is ordered to show cause by 7/20/2026 why he should not be sanctioned for making a frivolous filing.
