Pursuant to Local Civil Rule 1.4, "[a]ll motions to withdraw must be served upon the client and (unless excused by the court) upon all other parties. Proof of such service upon the client shall be filed on the docket in each case where withdrawal is sought." Counsel for Defendants must file proof of service upon their clients.

Order on Motion for Pre Motion Conference Order on Motion for Leave to File Excess Pages
ORDER denying 37 Motion for Pre Motion Conference; granting 43 Motion for Leave to File Excess Pages.
At ECF No. 43 , Plaintiff requests leave to exceed the three-page limit in response to Defendants' pre-motion letter. In his response at ECF No. 43-1, Plaintiff seeks leave to amend his Complaint and indicates that "Plaintiff has retained counsel, who will be able to research and evaluate Plaintiffs claims and make appropriate amendments, both removing and adding claims and further supporting allegations." See ECF No. 43-1 at 3. After consulting with the District Judge's chambers, the Court grants ECF No. 43 and allows the response letter at ECF No. 43-1 to remain filed on the docket. On or before 9/22/2026, Plaintiff's counsel is ordered to file a notice of appearance in this case.
The status conference before the undersigned will proceed on 9/29/2026 at 12:00 PM. At the conference, the parties should be prepared to propose a schedule for Plaintiff to file an amended complaint and Defendant to file a response thereto, provide updates about Plaintiff's pension benefits, and discuss the possibility of settlement, including possible participation in the Court-annexed mediation program. Defendants' pre-motion letter in anticipation of a proposed motion to dismiss at ECF No. 37 is denied with leave to renew after Plaintiff files an amended complaint.
The Court will mail a copy of this Order to Samuel Gay c/o Shakuwra Gay, 248 New York Avenue, Apt. 3L, Brooklyn, NY 11216. Plaintiff should immediately notify his attorney of this Order, particularly the requirement to file a notice of appearance.
