ORDER. For the reasons stated on the record during the October 14, 2021 hearing in this matter, the court orders the following: (1) Defendant's 160 Motion for Leave to Substitute Expert Witness is granted. (2) Defendant's 161 Motion to Modify Briefing Schedule is granted in part and denied in part. Defendant shall serve a substitute expert disclosure on or before October 29, 2021; Plaintiffs may take a deposition of Defendant's substituted expert on or before November 10, 2021; supplements to the parties' cross-motions for summary judgment and Plaintiffs' Daubert motion shall be filed on or before November 23, 2021; the parties' oppositions to the cross-motions for summary judgment and Defendant's opposition to Plaintiffs' Daubert motion shall be filed on or before December 3, 2021; and the parties' replies in support of their cross-motions for summary judgment and Plaintiffs' reply in support of their Daubert motion shall be filed on or before December 17, 2021. (3) Defendant's substitute expert may not rely on any information in addition to the information Jeffrey Spittel relied on to reach his opinions.
