Response in Support of Motion
RESPONSE IN SUPPORT PLAINTIFFS SUPPLEMENTAL RESPONSE TO ORDER TO SHOW CAUSE REGARDING FAILURE TO APPEAR AND REQUEST TO VACATE OR REDUCE MONETARY SANCTIONS filed by Plaintiff Beom Su Lee. (Lee, Beom)
Sanctions Dismiss/Lack of Jurisdiction
MINUTES (IN CHAMBERS) by Judge Mark C. Scarsi: ORDER IMPOSING SANCTIONS ON PLAINTIFF FOR FAILURE TO APPEAR. The Court held a hearing on July 20, 2026, regarding Defendants Jeonju Television Co., Ltd., KT Genie Music Corp., Kakao Entertainment Corp., MBC Corp., MBN, Inc., NHN Bugs Corp., SBS Corp., and TV Chosun Corp.'s motion for sanctions and motion to dismiss, and Defendant ODK Media, Inc.'s, motion to dismiss. Plaintiff Beom Su Lee failed to appear. This Court orders Plaintiff to show cause why sanctions should not be imposed for his failure to appear at the motion hearing. Plaintiff shall file a written response within seven days of this Order. Failure to file a timely response will result in sanctions, such as monetary sanctions or dismissal, without further notice. Further, the Court deems Plaintiff's failure to appear at the hearing a violation of Local Rule 7-14 and "willful disobedience of a court order." The Court imposes sanctions under Local Rule 83-7(b) and its inherent powers. The Court orders Plaintiff to pay Defendants the attorney's fees they incurred for their counsel's appearance at the motion hearing. The Court orders the parties to meet and confer on the amount. If the parties agree on the measure of the sanction, Plaintiff shall pay Defendants reasonable attorney's fees, and the parties shall file a joint statement indicating Plaintiff completed the payment within 14 days. If the parties cannot agree on the measure of the sanction, Defendants instead may file a motion for an award of fees, including fees incurred to file the motion, within 21 days. The Court takes the motions under submission and declines to reset the hearing 139 , 153 , 159 . (lc)
