ORDER. For the reasons set forth in the forthcoming Memorandum Opinion, that the Court DENIES Defendant Owens & Minor, Inc.'s ("O&M") 34 Motion to Dismiss Relator's Amended Complaint as Unconstitutionally Initiated. The Court GRANTS in PART and DENIES in PART O&M's 32 Motion to Dismiss for Lack of Subject Matter Jurisdiction and for Failure to State a Claim. The Court DENIES the Motion as to O&M's subject matter jurisdiction challenge and GRANTS the Motion as to O&M's argument that the Relator failed to state a claim upon which relief can be granted under the False Claims Act ("FCA"). The Court GRANTS in PART and DENIES in PART Defendant UnitedHealth Group, Inc.'s ("UnitedHealth") 30 Motion to Dismiss for Failure to State a Claim and for Lack of Standing Under Article II. The Court DENIES the Motion as to UnitedHealth's constitutional challenge and GRANTS the Motion as to UnitedHealth's argument that the Relator failed to state a claim upon which relief can be granted under the FCA.
