TEXT ORDER - The Court is in receipt of the SPG Settling Defendants' request for leave to file a motion for entry of a "bar order" barring all pending and future claims by non-settling potentially responsible parties to the extent those claims fall within the matters addressed in the proposed modified Consent Decree (ECF No. 318 ), which is joined by the CSG Liaison Group Settling Defendants (ECF No. 328 ), and opposed by intervenor OxyChem (ECF No. 329 ). The proposed modified Consent Decree is the subject of a pending motion to enter with objections from several non-settling parties. Should the District Court determine not to enter the proposed modified Consent Decree, any motion for entry of a "bar order" would become moot. The Court finds that the interests of party and judicial economy are best served by awaiting the outcome of the motion to enter the modified Consent Decree and then determining the propriety of the proposed "bar order" motion. Accordingly, the application for leave to file a motion for entry of a "bar order" is denied without prejudice as premature. The Settling Defendant groups may renew their application, if appropriate, following the District Court's adjudication of the motion to enter the proposed modified Consent Decree.
