District Judge Angel Kelley: ELECTRONIC ORDER entered.On 8/17/2026, Magistrate Judge Kelley issued a Report and Recommendation [Dkt. 130] on Defendants’ Motion to Dismiss for failure to state claim and improper venue, and motion to strike [Dkt. 64]. The parties did not file any objections to the Report and Recommendation by the deadline of 8/31/2026. After careful review of the Report and Recommendation and the record, the Court hereby ADOPTS the 130 Report and Recommendation in its entirety. Accordingly, Defendants' motion to dismiss pursuant to Fed. R. Civ. P. 12(b)(3), to the extent it seeks transfer of venue, is GRANTED. Defendants' motion to dismiss Count VI (RICO claim), pursuant to Fed. R. Civ. P. 12(b)(6), is DENIED AS MOOT because of Plaintiff Larrimore's voluntary dismissal of that claim. Defendants' motion to strike, pursuant to Fed. R. Civ. P. 12(f), is DENIED WITHOUT PREJUDICE. Within seven (7) days from the date of this order, Plaintiff Larrimore shall submit the district she wishes the Court to transfer her action pursuant to 28 U.S.C. § 1391(b)'s requirements. (MAL)
