IN CHAMBERS ORDER by Judge R. Gary Klausner: ORDER LIFTING STAY.After the parties in this action each moved for summary judgment, the Court entered judgment in favor of Plaintiffs Fidelity Brokerage Services LLC and National Financial Services LLC. (ECF Nos. 94, 98.) Subsequently, Defendant-Appellant Pacific Western Bank appealed the judgment to the Ninth Circuit. (ECF No. 102.)In accordance with the parties' joint stipulation, the Court ordered that the automatic stay on execution of judgment pursuant to Federal Rule of Civil Procedure 62(a) be extended until the issuance of the Ninth Circuit 's judgment in the above-referenced appeal, or alternatively until both sides mutually agreed for the stay to be dissolved, whichever was earlier. (ECF No. 105.) On April 25, 2025, the Ninth Circuit granted the volunta1y dismissal of the aforementioned appeal. (ECF No. 110.) Since the appeal has been dismissed, the Court ORDERS the stay of this case to be lifted. (lc)
