Order on Motion for Continuance
(Text-Only) ORDER granting 73 Motion for Continuance.
Defendant has shown good cause to reschedule the October 21, 2026 hearing. Lead counsel was available for the original October 13 hearing date, and Defendant promptly advised Chambers of a preexisting conflict after the hearing was moved to October 21.
The original October 13, 2026 date must be continued; however, the matter cannot be continued months into the future. This case is trial-ready as of October 14, 2026, briefing on the summary judgment and Rule 702 motions is complete, and the next generally available hearing date would not be until January 2027. In light of that schedule, and due to recent cancellations, the hearing will be reset to one of the following dates: Friday, October 2, 2026 at 10:00 a.m. or Monday, October 5, 2026 at 2:00 p.m.
The parties shall meet and confer and advise Chambers no later than Tuesday, September 15, 2026, which of those two dates they can accommodate. If both dates are available, the hearing will be set on the earlier date. If counsel cannot agree, the hearing will be set on the date selected by this Court.
