For reasons stated on the record, the Court GRANTS IN PART AND DENIES IN PART Defendant Alston Construction Company Inc.'s Expedited Joint Motion for Discovery Pursuant to LCR 37(a)(2) re Plaintiffs' Notice of Videotaped 30(b)(6) Deposition of Alston Construction Company Inc., Dkt. No. 30 . In light of the Court's ruling, the Parties were able to reach the following agreement:

   Regarding Plaintiff's Notice of CR 30(b)(6) Deposition, topics 4(c) and (d) will be amended to three years of Alston's annual gross revenues and profits preceding the incident and topic 5 (a) and (b) will remain unchanged.

   Alston is hereby Ordered to produce a witness prepared to answer questions relating to the following:
   - Three years of Alston's annual gross revenues and profits preceding the incident;
   - The gross revenues and profits from the FRED 310.

   Any information obtained concerning these topics will be subject to a protective order limiting its use and disclosure to this litigation. Defendant Alston will prepare and provide Plaintiff with a proposed stipulated protective order for review. (KMP)
