Order on Motion for Leave to Proceed In Forma Pauperis
TEXT ORDER. Pursuant to the review mandated by 28 U.S.C. § 1915(e)(2)(B)(ii), the Court has reviewed the Complaint (ECF No. 1 ) and the accompanying Application for In Forma Pauperis Status (ECF No. 2 ). While the plaintiff has demonstrated an inability to pay the filing fee, his Complaint fails to state a cognizable cause of action. The Complaint does not include a short and plain statement of the claim showing that the pleader is entitled to relief. Fed. R. Civ. P. 8(a)(2). In addition, the Complaint has various more specific deficiencies. The causes of action for which he invokes the federal question jurisdiction of this Court, are criminal statutes which he as an individual cannot prosecute. 18 U.S.C. § § 241 and 242. Second, the Complaint states no facts at all to support any allegation of deprivation of civil rights, which is what Mr. Landry presumably intends to claim(the statutes he invokes punish deprivations of civil rights). Third, there is no attempt in the Complaint to link any defendant to specific acts that might support civil liability. Fourth, Mr. Landry seeks onlymonetary damages ($500 Million) and many of the defendants he sues are state agencies from which damages could not be collected, at least not in an action under 42 U.S.C. § 1983. Will v. Michigan, Department of State Police, 41 U.S. 58 (1989). The Complaint is DISMISSED and the Application for In Forma Pauperis status is DENIED as moot. So Ordered by District Judge Mary S.
