STIPULATION AND ORDER OF DISMISSAL WITH PREJUDICE PURSUANT TO F.R.C.P. 41(a)(1)(A)(ii) AND 41(c) IT IS HEREBY STIPULATED AND AGREED between Plaintiff/Counterclaim Defendant Olon S.p.A. ("Olon") and Defendant/Counterclaim-Plaintiff Perfect Day, Inc. ("PerfectDay") that (i) all of Olon's claims against Perfect Day in the above-captioned action, and (ii) all of Perfect Day's counterclaims against Olon in the above-captioned action, are hereby dismissed with prejudice in their entirety pursuant to Federal Rules of Civil Procedure 41(a)(l)(A)(ii) and 4l(c), without interest to any party and each party to bear its own attorneys' fees and costs.
