ORDER by Magistrate Judge Susan Prose on 09/09/2026. This matter is before the court pursuant to the parties' 43 Joint Motion for Settlement Conference. Having reviewed the parties' respective positions, this court does not find sufficient cause to modify its settlement protocol to permit parties to attend remotely, nor does the court believe that it could effectively assist the parties in achieving a settlement in this case by remote means under the unique circumstances present here. The parties are encouraged to consider engaging a private mediator. In order to permit the parties additional time to identify a mediator that is suitable under the parties' particular circumstances, the court finds good cause to extend deadlines in this case. Accordingly, the 43 Joint Motion for Settlement Conference is GRANTED in part, and the Scheduling Order is amended as follows:
