Pretrial Conference Scheduling Conference
Minute Entry for proceedings held before Magistrate Judge Diana Song Quiroga. Initial Pretrial and Scheduling Conference held on 4/22/2024 by video conference. Plaintiff appeared through counsel Alan Tysinger; Defendants Post Holdings, Inc., and Post Foods, LLC, appeared through counsel Robert Sean Page; and Defendant Schneider National Carriers, Inc., appeared through counsel Lynn S. Castagna. The Court held an Initial Pretrial and Scheduling Conference. This is a case about personal injuries allegedly sustained at a tractor-trailer loading dock. Attorney Tysinger is moving for admission pro hac vice, which Defendants do not oppose. Initial disclosures are complete. The parties intend to mediate the case in the next ninety days. The Court GRANTED Defendant Schneiders Unopposed Motion to Compel Arbitration & Stay Proceedings as to it, Dkt. No. 6 . The case will proceed on a litigation track as to the other Defendants. The Court ORDERED the parties to file a joint advisory of the status of the case by 8/2/24. The Court also GRANTED Defendant Schneiders Unopposed Motion for Leave to Amend Answer. Dkt. No. 4 . Plaintiff moved unopposed for leave to file an amended answer, and the Court Granted the Motion and ORDERED him to file his amended complaint within 30 days, after which Defendants Post Holdings and Post Foods deadlines to amend their answers shall be in accordance with the Federal Rules of Civil Procedure and Local Rules. The Court adopted these discovery deadlines: joinder of all parties 8/12/24, opt into Court mediation 9/13/24, complete ADR 11/1/24, amend pleadings 11/15/24, Plaintiff expert witness designation 5/16/25, Defendants expert witness designation 6/16/25, file dispositive motions 7/15/25, status conference 7/25/25, complete discovery 7/30/25.
