ORDER AND STIPULATION WITHDRAWING AFFIRMATIVE DEFENSES AND JURY TRIAL DENIAL : IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned attorneys for the Parties, that Defendant hereby withdraws its Second Affirmative Defense (statute of limitations), as set forth in paragraph 86 of its Answer; IT IS FURTHER STIPULATED AND AGREED that Defendant hereby withdraws its Third Affirmative Defense (laches, estoppel, and waiver), as set forth in paragraph 87 of its Answer; IT IS FURTHER STIPULATED AND AGREED that Defendant hereby withdraws its Fifth Affirmative Defense (supplemental jurisdiction), as set forth in paragraph 89 of its Answer; IT IS FURTHER STIPULATED AND AGREED that Defendant hereby withdraws its Sixth Affirmative Defense (unclean hands), as set forth in paragraph 90 of its Answer; IT IS FURTHER STIPULATED AND AGREED that Defendant hereby withdraws its denial that Plaintiff is entitled to a jury trial, as set forth in paragraph 83 of its Answer. IT IS FURTHER STIPULATED AND AGREED that a facsimile and/or electronic signature of the undersigned shall be deemed original, and that this Stipulation may be filed with the Clerk of the Court without further notice to either party.
