TEXT ORDER granting 32 Plaintiff's Motion to Amend Complaint. Plaintiff's Motion seeks leave to amend the Complaint pursuant to Federal Rule of Civil Procedure 15(a)(2) and has attached a proposed Amended Complaint to the Motion. ECF Nos. 32; 32-1. Defendant does not oppose the Motion. See ECF No. 35 at 1. Rule 15(a)(2) states that "a party may amend its pleading only with the opposing party's written consent or the court's leave. The court should freely give leave when justice so requires." "A motion to amend should be denied only when the amendment would be prejudicial to the opposing party, there has been bad faith on the part of the moving party, or the amendment would be futile." HCMF Corp. v. Allen, 238 F.3d 273, 276 (4th Cir. 2001). Given that this action is in the pleading stage and that Defendant does not oppose Plaintiff's request for leave to amend, the undersigned finds that the amendment is not unduly prejudicial and that there is no evidence of bad faith. Accordingly, Plaintiff's Motion is granted. Plaintiff is directed to file the proposed Amended Complaint attached to the Motion. IT IS SO ORDERED. Signed by Magistrate Judge William S.
