Final Judgment Under Federal Rule Of Civil Procedure
FINAL JUDGMENT UNDER FEDERAL RULE OF CIVIL PROCEDURE 58 - Having directed the entry of final judgment, the Court now enters FINAL JUDGMENT. The Court enters judgment in favor of Defendants Nice Pak Products, Inc. and Professional Disposables International, Inc., as to Plaintiffs Darin Johnson and Robert Willey's claims for unjust enrichment, bailment, and violation of the New York Deceptive Trade Practices Act, pursuant to the Court's June 5, 2024, Order. Those claims are dismissed without prejudice. The Class Members' claims for negligence, negligence per se, and breach of implied contract against Defendants are resolved pursuant to the Court's July 1, 2026, Order approving the parties' Revised Class Action Settlement Agreement and Release. Those claims are dismissed without prejudice. The Court retains jurisdiction to enforce the terms of the Revised Agreement. ORDER DENYING 94 JOINT MOTION FOR CORRECTED FINAL APPROVAL ORDER: If the parties wish to file a renewed motion to amend the final order, consistent with this order and Shapo, they must do so by August 11, 2026. If the parties do not file a renewed motion to amend by August 11, 2026, the Court will enter final judgment dismissing the Class Members' claims without prejudice and retaining jurisdiction over the Revised Agreement.
