ORDER granting 28 Construed Unopposed Motion to Amend the Temporary Restraining Order. Paragraph 2 of the 20 Temporary Restraining Order shall be substituted in its entirety to state as follows: (2) Plaintiff's request for a temporary restraining order is GRANTED to the extent that: (a) Defendant SHALL preserve all documents, materials, and data (and copies thereof), in tangible, electronic, or intangible form in Defendant's possession relating to Plaintiff's business, except pursuant to an agreement by the parties on a forensic protocol for retrieving such information. (b) Defendant is further TEMPORARILY ENJOINED from accessing, using, destroying, or duplicating any of Plaintiff's trade secrets or confidential information, and from disclosing such information to any third party, except pursuant to an agreement by the parties on a forensic protocol for retrieving such information. (c) Defendant SHALL abide by the terms of the Agreement (Doc. 10-1), including the Non-Solicitation Provisions and Non-Disclosure Provisions, as those terms are defined herein.
