Minute Order Order on Motion to Dismiss
MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 6/25/2026 Granting 3 Evan Tyler Feldstein's Motion to Dismiss.
Defendant Evan Tyler Feldstein filed a motion to dismiss all claims against him as insufficiently pled. 3 Plaintiff's opposition to that motion was due by 6/23/26, but plaintiff neither filed an opposition nor moved to extend the deadline to do so. Local Rule 7-2(d) provides that "[t]he failure of an opposing party to file points and authorities in response to any motion, except a motion under Fed. R. Civ. P. 56 or a motion for attorneys fees, constitutes a consent to the granting of the motion." I apply this rule and construe the plaintiff's lack of an opposition as her consent to grant it. IT IS THEREFORE ORDERED that Feldstein's motion to dismiss 3 is GRANTED, the claims against Feldstein are DISMISSED, and the Clerk of Court is directed to TERMINATE Evan Tyler Feldstein as a defendant.
