EO: On 4/30/2026, the Court issued a 2 Deficiency Order warning Plaintiff that failure to pay the filing fee or submit an application to proceed in forma pauperis ("IFP Application") within twenty-eight days would result in AUTOMATIC DISMISSAL of the action for failure to prosecute or otherwise follow a court order. See ECF No. 2 at 1-2. To date, Plaintiff has not paid the filing fee or submitted an IFP Application. The Court thus DISMISSES this case without prejudice. See Fed. R. Civ. P. 41 (b); Olivares v. Marshall, 59 F.3d 109, 112 (9th Cir. 1995) (stating that the district court may dismiss a complaint for failure to pay partial filing fee); In re Perroton, 958 F.2d 889, 890 (9th Cir. 1992) (affirming dismissal of appeal of pro se litigant for failure to pay required filing fees). The Clerks office shall close this case.
