Minute Order Order on Discovery Plan and Scheduling Order
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 7/23/2026. By Law Clerk: S. Gorba.
The Court has before it a document titled Discovery Plan and Scheduling Order as well as a Motion to Stay Discovery. ECF Nos. 43 , 44 . The proposed plan and order is not joint, but conditionally joint only if a stay of discovery is not granted. Thus, the Court finds the only issue properly before it, once ripe, is whether to stay discovery. The Court will promptly decide the motion seeking a stay of discovery once it is fully briefed.
Accordingly, IT IS HEREBY ORDERED that the Discovery Plan and Scheduling Order (ECF No. 43 ) is DENIED without prejudice. If the Motion to Stay discovery is also denied, then a joint Discovery Plan and Scheduling Order will be due on a date set by the Court. Otherwise, the parties must operate at this time as permitted under Federal Rules of Civil Procedure 26.
