STARWILD MUSIC INC., APOLLO'S CHARIOT MUSIC and BANANA ALERT MUSIC as parties to this Action, The aforementioned publishing entities were never served a Summons and Complaint, and no appearances are docket for them. 3. No Party to the Action has filed an Answer or a Motion for Summary Judgment. 4. Plaintiff has a unilateral right to Voluntarily Dismiss this Action, pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i).
