Status Conference Order on Motion for Extension of Time to Complete Discovery 1 - Terminate Deadlines and Hearings

THE FOLLOWING RULINGS WERE MADE:
Following discussion with counsel during the Status Conference, the parties' joint Motion for an Extension of Time to Complete Discovery (see ECF No. 77 ) is GRANTED. The following discovery dates and deadlines have been extended:
(i) The close of all discovery, including expert discovery, is extended to December 31, 2026.
(ii) The final date by which the parties shall take the first step in summary judgment motion practice is extended to January 29, 2026.
The parties are directed to file a joint Status Report on or before December 4, 2026, advising the court of the status of any remaining discovery and whether the parties intend to proceed with Summary Judgment motion practice.
A Settlement Conference in this matter was held on February 17, 2026, before the undersigned. In the event the parties would like to have a continued Settlement Conference, the parties are directed to contact the undersigned's Courtroom Deputy, via e-mail at Eric_Russo@nyed.uscourts.gov, with mutually convenient dates that the parties are available. In the alternative, should the parties wish to pursue Mediation, counsel may submit a joint written request to the undersigned for a referral to the EDNY Mediation panel.
