Initial Conference Hearing Order on Motion for Reconsideration
Minute Entry and Order: An Initial Conference was held via video on 7/2/2026 before Magistrate Judge Taryn A. Merkl. Appearances by Andrew Obergfell and Yitzchak Kopel for Plaintiff; Justin Kontul and Mark Bini for Defendant Service Finance Co.; Ashwini Jayaratnam and Hannah Sfameni (no notice of appearance) for the Defendants Attyx, LLC, Attyx New York LLC, Grant Young, and Benson Payne (the "Attyx Defendants"); Robert Guite and Sophia Cahill for Defendant Solar Mosaic LLC. Discussion held regarding case status and the parties' positions on discovery due to the forthcoming pre-motion conference before the Hon. Nicholas G. Garaufis regarding the anticipated motions to compel arbitration. As discussed on the record, in light of the forthcoming pre-motion conference before Judge Garaufis, the Court grants Defendant Service Finance's letter motion 42 for reconsideration. Defendant Service Finance's deadline to answer or otherwise respond to the complaint is held in abeyance, pending the outcome of the anticipated motions to compel arbitration that are contemplated by the Attyx Defendants and Solar Mosaic. Additionally, as discussed on the record, the parties are directed to meet and confer to exchange any exhibits to be used in the forthcoming motions to compel arbitration as well as any related hearing, should a hearing be ordered. All other discovery is stayed, pending the outcome of the forthcoming motions.
Counsel Hannah Sfameni is respectfully directed to file a notice of appearance by 7/10/2026 should she intend to appear in the case going forward. See EDNY Local Civil Rule 1.4 (requiring attorneys to file a notice of appearance "promptly upon the attorney's first appearance or filing in the case"). Ordered by Magistrate Judge Taryn A.
