Order on Motion for Extension of Time to Set/Reset Deadlines
MINUTE ORDER denying 23 Motion for Extension of Time: Plaintiff's 23 motion for an extension of time is DENIED without prejudice. The Court recently granted Plaintiff's counsel's motion to withdraw. ECF 24. A plaintiff may "plead and conduct their own cases personally or by counsel," but a pro se plaintiff cannot "pursue the claims of the United States, or anyone apart from himself, without counsel." Smither v. U.S. Dep't of Just., No. 25-cv-2959, 2025 WL 3458779, at *1 (D.D.C. Nov. 20, 2025); U.S. ex rel. Lovern v. Deutsche Bank Trust. Co. Ams., No. 14-7186, 2015 WL 2226230, at *1 (D.C. Cir. May 6, 2015) (noting that a party could not pursue a pro se qui tam action under the False Claims Act because "the claims at issue belong to the government"). Accordingly, Plaintiff must retain new counsel if he wants to proceed with his False Claims Act suit on behalf of the United States. The Court hereby ORDERS that this case, including all deadlines, is STAYED for 60 days until August 31, 2026, to permit Plaintiff time to secure new counsel. If no new counsel enters an appearance, the Court may dismiss the matter without prejudice. The Court notes that Defendants oppose any extension of the deadline, ECF 28, but the Court is not granting any extension at this time. The Court will consider any motion for extension of deadlines as necessary once Plaintiff has engaged new counsel. Signed by Judge Jia M. Cobb on July 1, 2026. (lcjmc2)
