TEXT ORDER: On May 30, 2017, the Court entered an Order incorporating the Parties' settlement Agreement, retaining jurisdiction for the purposes of the Settlement Agreement, and appointing the Honorable Joel A. Pisano (Ret.) as special master for the purposes of resolving the disputes pursuant to the Settlement Agreement. (ECF No. 115 .) Within the Settlement Agreement, paragraph 55 provided, "Within five (5) days of the effective date of this Agreement, the Parties shall jointly file with the Court a motion to stay of the Civil Action." (Settlement Agreement 55, ECF No. 115 .) The Parties stated they would ask the Court for a stay pending the following conditions, "(a) the preliminary and final site plans for ISBR's mosque have been approved," and "(b) Ordinance # 2242 is amended in accordance with paragraph 38" of the Settlement Agreement. (Id.) The Parties failed to timely request that stay. The Court, accordingly, sua sponte implements that stay, and administratively terminates the case. Upon expiration of the Court's retention of jurisdiction, the Parties shall file a stipulation of voluntary dismissal of the case. So Ordered by Judge Michael A. Shipp on 3/29/2019. (gxh)
