MEMORANDUM OPINION & ORDER re: 65 MOTION to Dismiss : Defendant's Motion to Dismiss Plaintiff's Second Amended Complaint Pursuant To Federal Rule Of Civil Procedure 12(B)(6).. filed by Socure Inc. As stated above, Defend ant's motion to dismiss is GRANTED IN PART and DENIED IN PART. The motion to dismiss Mr. Madhu's breach of contract claims related to his attempted exercise of his options in 2021 is granted. The motion to dismiss his breach of the impli ed covenant of good faith and fair dealing claim with respect to those attempts to exercise his options is denied. The motion to dismiss his breach of contract and breach of the implied covenant of good faith and fair dealing claims with respect to his 2023 attempted "net exercise" of options is granted with respect to his Second Option Award. The motion to dismiss those claims with respect to the First Option Award is denied. The Clerk of Court is directed to terminate the motion at Dkt No. 65. (Signed by Judge Gregory H. ORDER granting 87 Letter Motion for Extension of Time. The parties request for an extension of time to complete discovery, Dkt. No. 87, is granted. The deadline for the completion of all fact discovery is extended to July 24, 2024. The deadline for the completion of all expert discovery is extended to September 6, 2024. Every party-proponent of a claim (including any counterclaim, cross-claim, or third-party claim) that intends to offer expert testimony in respect of such claim must make the disclosures required by Fed. R. Civ. P. 26(a)(2) by July 24, 2024. Every party-opponent of such claim that intends to offer expert testimony in opposition to such claim must make the disclosures required by Fed. R. Civ. P. 26(a)(2) by August 7, 2024. The deadline for submission of motions for summary judgment, if any, is extended to September 30, 2024. The status conference scheduled for July 25, 2024 is adjourned to September 19, 2024 at 4:00 p.m. The joint status letter requested in the case management plan and scheduling order entered on October 17, 2023, Dkt. No. 53, is due no later than September 12, 2024. Except as expressly modified by this order, the case management plan entered by the Court on October 17, 2023, Dkt.
