ORDER adopting 38 Report and Recommendation. Having conducted a de novo review of Chief Magistrate Judge Eddy's Report & Recommendation and a de novo review of the record in this case, and having considered that no objections to the Report & Recommendation were filed, the Court finds no clear error on the face of the record. It is ORDERED that Defendant's 30 , 34 Motions to Dismiss are granted, Plaintiff's claims are dismissed with prejudice, and the 38 Report and Recommendation is adopted as the opinion of the Court. Specifically, the Court concludes that dismissal with prejudice (as opposed to without prejudice) is appropriate for the reasons outlined in the R&R, and for the additional reasons that Plaintiff filed no objections to the R&R, no request for leave to amend or modify the pre-trial deadlines, and no request that the complaint be dismissed without prejudice as an alternative sanction.
