Order on Motion to Compel
ELECTRONIC ORDER regarding 495 Motion to Compel. The Court is in receipt of a Letter submitted by Samuel H. Rudman of Robbins Geller Rudman & Dowd LLP and Nicole M. Zeiss of Labaton Keller Sucharow LLP (hereafter, "Co-lead Counsel") requesting to retain the outstanding remission funds escrow account balance of $487,163.45 as attorneys' fees for their efforts in this matter (hereafter, the "Letter-Request", ECF No. 495 ). In the Letter-Request, Co-Lead Counsel represented: (1) $71 million in remission proceeds were recovered in this case; (2) as a result of such recovery, all class members/claimants who submitted eligible claims received 100% of their recognized losses; and (3) Co-Lead counsel engaged in thousands of hours of uncompensated time. On September 26, 2024, the Court issued an Electronic Order providing all Defendants, Interested Parties, and Intervenors the opportunity to respond to the Letter-Request by no later than October 10, 2024. Having received no responses, let alone objections, from any party concerning the Letter-Request, and upon thorough review of the Letter-Request and consideration of Co-Lead Counsels efforts in this matter, the Court finds the Letter-Request to be reasonable and appropriate. Accordingly, IT IS HEREBY ORDERED, Co-Lead counsel shall retain the outstanding remainder sum in the remission funds escrow account, which at the time of their Letter-Request was $487,163.45. Ordered by Judge Joanna Seybert on 10/17/2024. (AME)
