TEXT ORDER-- TEXT ORDER: The Court is in receipt of Defendant's letter seeking leave to file a motion for a protective order concerning the permissible scope of Plaintiff's deposition of Richard Davis. (ECF No. 125 ). Plaintiff shall file a responsive letter, no longer than 5 double-spaced pages, by August 11, 2026. In that letter, Plaintiff shall specifically address whether it agrees to limit the scope of its deposition questions to Mr. Davis's factual knowledge about the Groton facility during the time period he was employed and not question him about any knowledge he gained since being retained by Pfizer as a non-testifying consulting expert in February 2024. If Plaintiff is seeking to question Mr. Davis regarding the latter, it should explain what "exceptional circumstances" exist that would warrant such an inquiry, and why it cannot be obtained from another source. The Court will then decide whether formal motion practice or a discovery dispute conference (or both) is warranted. So Ordered by Magistrate Judge Stacey D. Adams on 8/5/2026. (JB)
