STIPULATION OF CONDITIONAL VOLUNTARY DISMISSAL WITHOUT PREJUDICE PURSUANT TO FED. R. CIV. P. 41(a)(1)(A)(ii): WHEREFORE, IT IS HEREBY STIPULATED AND AGREED THAT: A. In accordance with Federal Rules of Civil Procedure 41(a)(1)(A)(ii), the parties stipulate that all claims against Defendant Huberfeld shall be dismissed, subject to renewal upon a reversal or affirmance the of the Dismissal Order by the Second Circuit Court of Appeals; B. Dismissal is without prejudice and without costs to either party; and C. As to the named Plaintiffs only, all presently-asserted claims against Defendant Huberfeld are tolled until an order reversing of affirming the Dismissal Order is issued by the Second Circuit.
