Text Order 1 - Terminate Hearings ~Util - Set Hearings
TEXT ORDER - The Court has the authority to sua sponte consider the admissibility of expert testimony under Daubert v. Merrell Dow Pharmaceuticals, 509 U.S. 579 (1993), where there is an adequate record upon which to base the Court's decision. See Dandy v. Ethicon Women's Health & Urology, No. 20-431, 2022 WL 1284735, at *14 (D.N.J. Apr. 29, 2022) (collecting cases). Cf. Henry v. St. Croix Alumina, LLC, 572 F. App'x 114, 119 (3d Cir. 2014) ("We accordingly conclude that the District Court properly acted within its discretion in declining to hold a Daubert hearing sua sponte."). The record before the Court provides enough information to consider the admissibility of Plaintiff's expert, and the Court is prepared to render a decision on that issue. However, in the interests of completeness and allowing the parties to be heard, the status conference, currently scheduled for September 23, 2026 at 12:00pm, is hereby ADJOURNED until October 7, 2026 at 12:00pm. Within one week of this Order, the parties shall submit briefs no longer than five (5) pages addressing whether the testimony of Plaintiff's expert is admissible under Daubert. At the October 7, 2026 status conference, the parties shall be prepared to discuss the admissibility of Plaintiff's expert testimony. So Ordered by Judge Julien Xavier Neals on 9/22/2026. (kd)
