MINUTE entry before the Honorable LaShonda A. Hunt: The Court has reviewed the parties' joint status report 35 on settlement progress. For over four months now, the parties have repeatedly asked for extensions of time because they are actively pursuing settlement. The Court stayed all deadlines in the case to afford them the opportunity to focus their resources on resolution. Now the parties report that they have reached agreement on the majority of terms; however, they still need seven more days to try to work out the final few items. The devil is always in the details. In other words, whether a final agreement is a realistic prospect depends on the scope of the remaining negotiations, which neither party has divulged to the Court nor should they. At this point, though, each updated status report is the samewe are close but need a bit more time. While the Court encourages early settlement, this case has been pending here for nearly seven months now (it had been filed a month earlier in state court) and the parties have not managed to move beyond the pleadings stage. Therefore, it is time to proceed on dual tracks. The parties should continue to discuss settlement and promptly file a stipulation of dismissal if their efforts are successful, but the stay of deadlines is lifted. Defendant's Answer to Count I of Plaintiff's Complaint is due by 7/2/24. Parties are ordered to meet and confer for a Rule 26(f) scheduling conference and file a proposed discovery plan by 7/16/24. Briefing on Defendant's Partial Motion to Dismiss 17 will proceed as follows: (1) Plaintiff's response is due by 7/2/24; and Defendant's reply is due by 7/16/24.
