ORDER: The Court hereby ORDERS the following: 1. The parties' proposed protective order (DE 27 ) is APPROVED. 2. The parties' proposed ESI protocol (DE 29 ) is APPROVED. 3. The joint status report directed to the undersigned addresses the possible relevance of the recent decision in Vidal v. The Hershey Company, No. 0:24-cv 60831-MD (S.D. Fla. Sept. 16, 2026). See DE 30 -1. In the event that Defendant is relying on the Vidal decision in connection with its pending pre-motion letter (DE 23 ), Defendant should make a separate submission to Judge Joan M. Azrack. Furthermore, in the event that Defendant is relying on the Vidal decision as a basis for the undersigned to reconsider the prior oral denial of the motion to stay discovery on 6/22/2026 (DE 21 ), it is hereby ORDERED that Defendant shall (1) obtain a transcript of the 6/22/2026 proceeding and file it on ECF by 10/16/2026, and (2) file the appropriate letter motion seeking reconsideration by 10/23/2026. In the event that Defendant files such a letter motion, Plaintiff's response is due 11/6/2026. 4. Any other relief sought in DE 30 is DENIED WITHOUT PREJUDICE Ordered by Magistrate Judge Lee G.
