Order on Motion for Discovery
ENDORSED ORDER granting-in-part and denying-in-part the plaintiff Beloved Pet, Inc.'s motions for discovery sanctions against the pro se defendants Bahri Ogretmenoglu and Miray Ogretmenoglu. Docs. 53, 54. Oral argument during the September 1, 2026, show cause hearing, Doc. 55, and the defendants' late and deficient discovery responses, Doc. 60, confirm that the defendants failed to comply with the July 31, 2026, order. Doc. 50. The defendants' non-compliance is neither substantially justified nor are there other circumstances making an award of expenses unjust. Fed. R. Civ. P. 37(b)(2)(c). Thus, plaintiff's request for reasonable expenses is GRANTED. Doc. 53 at 23; Doc. 54 at 24. The plaintiff's requests for additional sanctions under Rule 37(b)(2)(A) are DENIED. Id. ("Instead of or in addition to the orders above, the court must order the disobedient party... to pay the reasonable expenses, including attorney's fees, caused by the failure[.]"). Order Directing Compliance
ENDORSED ORDER: no later than September 30, 2026, the parties must confer and attempt to agree on the reasonable amount of attorney's fees and expenses that the plaintiff Beloved Pet, Inc. incurred in moving for discovery sanctions. Docs. 53-54. If the parties cannot agree, Beloved Pet must file, no later than October 9, 2026, a supplemental motion for fees that complies with Local Rule 7.01(c), along with an affidavit or declaration with supporting records describing Beloved Pet's expenses incurred in moving for discovery sanctions.
