Order on Motion to Amend/Correct/Supplement Order on Motion for Leave to File ~Util - Set Deadlines
ORDER: The 40 Motion for Leave to Amend is granted. Leave to amend should be freely granted unless there is a good reason for denying it, such as futility, bad faith, undue delay, or undue prejudice to the opposing party. See Jin v. Metro. Life Ins. Co., 310 F.3d 84, 101 (2d Cir. 2002). Here, the Court finds no bad faith, undue delay and undue prejudice in Plaintiff's motion. Defendants argue that Plaintiff's proposed amendments should be denied as futile. These futility arguments involve the entirety of Plaintiff's claims rather than the proposed amendments. The Court finds that Defendants' arguments would be better addressed in a motion to dismiss, which includes both the First Amended Complaint and the proposed amendments.
Accordingly, the Court grants Plaintiff leave to file a Second Amended Complaint by no later than July 15, 2026. Ordered by Magistrate Judge Peggy Kuo on 7/9/2026. (KS)
